What is discrimination?
Discrimination is the treatment, disadvantage or exclusion of people based on (personal) characteristics. These characteristics are, for example, your gender, nationality or age. Your employer is also not allowed to treat you differently based on the number of hours you work or your type of contract. Discrimination is prohibited in the Netherlands, it’s the law.
How do you recognize indirect discrimination?
With direct discrimination, it is clear that someone is being treated differently based on, for instance, age, gender or religion. Indirect discrimination is more subtle and occurs mainly in the recruitment and selection process. Companies no longer ask for a white man, but for a strong candidate who speaks Dutch fluently. Or the vacancy emphasizes the fact that you will be working in a team with only men.
A good reason for the distinction
Not in all cases are a question of discrimination. Some companies have a correct explanation for their requirements. For example, for a position as a cable puller, it makes sense to look for a candidate with muscles. And as a foreman, it is beneficial that you speak the same language as your team. In such cases, it is not indirect discrimination, but they are simply looking for the best candidate.
How do you deal with discrimination?
Do your colleagues regularly make jokes or comments about your sexual orientation? Or do you as a woman earn less than your male colleagues? Write these events down and discuss them with your employer or confidential adviser. They are obliged to do something against discrimination in the workplace.
